Degree of invalidity (LAI art. 28)
Comparison between the income without health impairment and the income reasonably expected with impairment — determines the level of the AI pension.
Reference : LAI art. 28-28a
The degree of invalidity opens entitlement to :
| Degree | Pension |
|---|---|
| 40 – 49 % | quarter pension |
| 50 – 59 % | half pension |
| 60 – 69 % | three-quarter pension |
| ≥ 70 % | full pension |
The calculation is governed by art. 16 LPGA : comparison between the “valid income” (without impairment) and the “invalid income” (reasonably expected). Three methods apply — ordinary (working), specific (no gainful activity), mixed (working and household).
It is the most-contested area in disability insurance. See our procedure : Disability insurance claim.
