Lugano enforcement certificate (LUG art. 53)

Standardised form issued by the court of origin certifying that a decision rendered in a Lugano State is enforceable and fit to circulate.

The enforcement certificate is used for monetary-condemnation decisions (maintenance, commercial debts) that must be enforced in another Lugano State.

It certifies :

  • the originating court;
  • the parties;
  • the enforceable character of the decision;
  • the amounts due, broken down by head of condemnation.

Without this certificate, the Swiss debt-enforcement office (LP) will generally refuse definitive mainlevée on the basis of a foreign decision.
