Brussels IIb — Regulation (EU) 2019/1111
Unified EU framework for jurisdiction, recognition and enforcement of matrimonial and parental-responsibility decisions between Member States.
Reference : BRX2T Regulation (EU) 2019/1111
Applicable since 1 August 2022, Brussels IIb replaces Brussels IIa for proceedings instituted from that date. It unifies :
- international jurisdiction in divorce, separation, annulment and parental responsibility;
- automatic recognition of decisions between Member States (art. 30 — no exequatur needed within the matter);
- child-return rules in abduction cases (arts. 22 ss — complement Hague 1980 between Member States).
Switzerland is not an EU Member State, so Brussels IIb does not apply directly in Switzerland. But it does apply to French decisions intended to circulate within the EU — hence an asymmetry that must be anticipated in any Swiss-French divorce.
